Terms & Conditions – Garbhshree

Acceptance

These Terms & Conditions (“Terms”) are an agreement between you and Ayurved Kunjika(“we”, “us”), TODO: Registered address, Pune, Maharashtra, India, and govern your use of the Garbhshree app and this website (together, the “Service”). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

Medical disclaimer

Garbhshree is not a medical device and does not provide medical advice. All content — including pregnancy week and due-date estimates, nutrition tips, diet charts, activities, shlokas and FAQ answers — is for general educational and wellness purposes only. It is not a substitute for professional medical advice, diagnosis or treatment.

Always consult your doctor or a qualified healthcare provider about your pregnancy, diet, exercise and medicines, and before making any health decision.
Never ignore or delay professional advice because of something you read in the app.
In an emergency — such as bleeding, severe pain, reduced baby movements, fever or breathing difficulty — contact your doctor or hospital immediately, or call112.

Due dates are estimates based on your last menstrual period (Naegele’s rule) and may differ from your doctor’s ultrasound-based dating. Garbh Sanskar content reflects traditional practice and is offered for well-being, not as a proven medical treatment.

Eligibility

You must be at least 18 years old and able to form a binding contract under Indian law to use the Service.

The app & its content

Garbhshree offers a pregnancy tracker, nutrition tips, brain activities, shlokas with meanings, frequently asked questions and the option to book doctor consultations, in English, Hindi and Marathi. We work to keep content accurate and up to date, but we do not guarantee that it is complete, error-free or suitable for your individual situation.

Doctor consultations

Consultations are provided by independent, registered medical practitioners, who are solely responsible for the advice they give. We facilitate the booking.
Consultations are online and time-limited (for example 10, 20 or 30 minutes). They arenot for emergencies and cannot replace an in-person examination where one is needed.
Please give accurate information when booking. Slots are subject to availability, and the clinic is closed on some days.
If a doctor cancels, you may reschedule or receive a refund. Rescheduling and refund rules for cancellations you make will be shown in the app before you pay.

Purchases & refunds

Garbhshree is free to download. Some content (such as stage-wise diet charts and the shloka collection) and consultations are optional paid purchases. Prices are shown in the app, in Indian Rupees and inclusive of applicable taxes, before you pay.
Digital content is a one-time purchase that unlocks the content for your use in the app. It is not a subscription.
Payments are processed by Google Play or the Apple App Store. Refunds for digital content are handled under the refund policy of the store you bought from. This does not affect your rights under the Consumer Protection Act, 2019.
Because the app stores data on your device, purchased content may need to be restored through the store if you reinstall the app or change phones.

Licence & acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes. You agree not to:

copy, resell, redistribute or publicly share paid content;
reverse-engineer, modify or bypass any purchase or security feature of the app;
use the Service for anything unlawful, harmful or misleading;
misuse consultations, for example by giving false information or harassing doctors.

Intellectual property

The Garbhshree name and logo, the Ayurved Kunjika name and emblem, and the app’s design, text, translations, illustrations, diet charts and compilation of content belong to us or our licensors. Traditional shlokas and mantras are in the public domain; our selection, translations and explanations of them are protected.

Your data

How we handle information is explained in our Privacy Policy. You are responsible for keeping your phone secure, because app data is stored on your device.

Availability & changes

We may add, change or remove features. Some features are marked “coming soon” and may change before release. We try to keep the Service available but do not promise it will always be uninterrupted or error-free.

Limitation of liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any decision you make based on the app’s content. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.

Indemnity

You agree to compensate us for losses arising from your breach of these Terms or misuse of the Service.

Termination

You can stop using the Service at any time by uninstalling the app. We may suspend or end your access if you seriously breach these Terms. Sections that by their nature should continue (such as the medical disclaimer, intellectual property and limitation of liability) survive termination.

Governing law

These Terms are governed by the laws of India. The courts at Nashik, Maharashtra have exclusive jurisdiction, subject to any rights you have as a consumer to bring a claim where you live.

Changes to these terms

We may update these Terms. We will change the “Last updated” date and, for significant changes, tell you in the app. Continuing to use the Service after changes take effect means you accept them.
